The amendment concerns adjustments to the registration process for use of the App.
1. INTRODUCTION
The company named “TELEKOM PAYMENTS – E-MONEY SERVICES SINGLE-MEMBER S.A.” (hereinafter “Telekom Payments” or the “Company”), with tax identification number 800995166 / Attica Tax Procedures and Services Centre (KEFODE Attikis), having its registered office at 99 Kifissias Boulevard, 151 24 Maroussi, Attica, and GEMI registration number 146551801000, is an electronic money institution (“EMI”) licensed by the Bank of Greece (“BoG”) under Law 4021/2011 (legislation on the supervision and regulation of financial matters in the Greek legal system), Directive (EU) 2015/2366 on payment services, as transposed into Greek law by Law 4537/2018, and the specific Executive Committee Act 164/2/13.12.2019 of the BoG, as in force, registered with the BoG under EMI number 3 to provide electronic money and payment services.
Telekom Payments creates and operates the Magenta Pay application (hereinafter the “App”) for its customers. Use of the App requires customers of Telekom Payments to accept these Terms fully and unconditionally. To use the services of the App, a customer must complete the identification and verification process in accordance with the “Framework Agreement for the Provision of Services – Terms of Use of the Telekom Payments E-Wallet” (hereinafter the “Framework Agreement”). Unless otherwise specified, the definitions in the Framework Agreement also apply to these Terms. Customers who have successfully completed identification and verification are referred to as “Identified Users”; customers who have not successfully completed that process are referred to as “Users”. Payment, electronic money, transaction-information and any future related services are governed by the Framework Agreement, which the Identified User accepts and which forms a single, indivisible whole with these App Terms; both are available in the App and on the Company's website. Through the App, Users may access registration services, while Identified Users may create and activate a payment account (IBAN), access it online, order and activate payment cards, carry out collection and payment transactions, issue electronic money by initiating transactions to load and unload their account, obtain transaction information and access any other payment, electronic-money or transaction-information services that the Company may offer through the App in future (collectively, the “Services”).
The App is intended exclusively for adults and must not be used by minors. If a minor uses the App, Telekom Payments accepts no responsibility, since protecting the minor is primarily the responsibility of the Identified User who has parental responsibility for that minor and who is solely liable to third parties.
Users and Identified Users may obtain information about the Company, its Services and the applicable terms on magenta.pay/de and telekompayments.com (hereinafter the “Website” or “Websites”).
2. TERMS OF USE OF THE APP
A User must complete identification and verification within thirty (30) calendar days after beginning the process. If the period expires without completion, the Company deletes all information and data registered or submitted by the User from its systems. To access the App and its Services, the User must start the identification and verification process again.
The Identified User acknowledges and accepts that access to the App and Services by any means is personal to that User, fully and unambiguously identifies their identity, and produces the same effects as their handwritten or approved electronic signature. Any action associated with use of the App or its Services is therefore presumed to originate from, and be authorised by, the Identified User, subject to proof to the contrary.
These Terms do not replace any obligations imposed on the User by Telekom Payments' general terms for the provision of other services (“Other Services”). To use Other Services in the App that are subject to special terms, the User must accept those particular terms. In the event of a conflict, the special terms of the relevant Other Service prevail. Telekom Payments may amend these Terms at any time without prior notice, but must update the text after each amendment or addition and inform Users through an announcement on the Website and in the App or by other appropriate means. Users must be informed of amendments; continued use of the App is deemed acceptance of the amended Terms.
The App is a Telekom Payments software product that is continually evolving and may be improved or modified as technology develops. Telekom Payments may, at its discretion, automatically modify the technical parameters, overall content and individual processes of the App without prior notice to Users, provided that these Terms are updated for each amendment or addition and a corresponding announcement is made on the Website and in the App. In particular, Telekom Payments may change the procedures and technical parameters governing Users' access to the App at its discretion.
3. APP INSTALLATION AND REGISTRATION
Telekom Payments makes the App available free of charge. Downloading and using the App may incur data charges under the User's provider's current price list. The App may be used while roaming, subject to applicable roaming charges.
The App is installed on a mobile telecommunications or electronic device, such as a smartphone or tablet, chosen by the User (the “Device”). It is compatible with Android version 8.0 or later and iOS version 15.0 or later. Use of the App requires the security settings of the Device on which it is installed to be enabled. The Company is not responsible for the User's choice of Device. The User must follow the instructions in the App to install it. The App may be installed on one or more Devices and may be uninstalled at any time. Uninstalling the App does not close or otherwise change the payment account held with Telekom Payments, but the User cannot use the account through the App or receive App Services unless the App is reinstalled. A User may continue to make payments using a Telekom Payments VISA debit card added to a third-party wallet (such as Apple Pay or Google Pay), in accordance with the terms of that wallet.
To register in the App, the User creates an account using the email address and mobile telephone number entered in the registration form. The email address must be confirmed using a four-digit verification code sent by email, valid for five minutes. The mobile number must be confirmed using a one-time password (“OTP”), valid for no more than five minutes, sent to the number entered in the registration form. The User selects either the mobile number or email address as the username. Registration is completed when the User creates a personal login password (“Password”).
Access to and use of the App also require the User to provide additional information through the App, either by (a) answering a specific questionnaire or (b) completing the mandatory fields for uploading documents within the App. A video call with a Telekom Payments specialist is then conducted. Alternatively, the App offers remote electronic identification by recording the User's dynamic selfie using specialised software without the presence of a Telekom Payments representative, provided that the identity document has a machine-readable zone (MRZ), which has been the case for all EU identity documents since 2019. Completing registration through this alternative method entails an annual credit limit of up to EUR 15,000. The User may have that limit removed at any time by initiating a video call with Telekom Payments through the App.
4. ACCESS TO THE APP
The User may access the App using one of the following methods:
I. Username and Password: The combination of username and Password enables secure login. The User may change either at any time by following the App's instructions. The username may be changed under Account Information > Change Phone Number / Change Email Address, and the Password under Security Settings > Change Password.
II. Fingerprint (Touch ID) or facial recognition (Face ID): To use these methods, the User's Device must have a fingerprint sensor or equipment capable of recognising unique three-dimensional facial features, must technically support the function, and the User must have activated it. The User should be thoroughly familiar with the operation of the required devices, media and software, including the fingerprint and facial-recognition functions. Telekom Payments does not collect, reproduce or store the User's fingerprint or facial-recognition data in any way. These biometric features are stored exclusively on the Device on which the User has installed the App.
The User must use only their own fingerprint (Touch ID) or face (Face ID) and is solely responsible for ensuring that no third party's identification or access credentials are stored in the App or on their Device.
Telekom Payments may introduce additional secure access methods in the future and inform Users through the App and/or Websites.
5. SERVICES PROVIDED THROUGH THE APP
Through the “Wallet” service, Identified Users can access their payment account and:
— view their electronic-money balance and account details (IBAN, beneficiary, etc.). The maximum permitted electronic-money balance is specified in the App;
— view all transactions and their details in chronological order, filter the results by specified criteria or search for a particular transaction;
— issue copies of transactions involving their payment account or linked cards (electronic receipts, either for individual transactions or collectively by quarter);
— initiate transactions to fund or withdraw funds from their payment account in the manner laid down in the Framework Agreement, within the transaction limits communicated in the App.
In addition to the Services, the following specific terms and conditions apply to Other Services:
I. “REFER A FRIEND” SERVICE
Through the “Refer a Friend” service, any Identified User may recommend Telekom Payments to third-party natural persons, such as friends, family members or partners, who are not yet Telekom Payments customers (each a “Friend”, collectively “Friends”), if the User believes they may be interested in opening an electronic-money account under the applicable terms, provided the conditions stated here are satisfied and communicated to the User through the App and/or the Company's Website. The referral is made by sending an invitation through the App in accordance with the conditions below.
“Process”
To use the service, interested Identified Users must log into the App, go to “Refer a Friend” and send their Friends a link via digital contact channels, such as email or digital messaging services, which the Friends receive on their mobile phones.
By sending the invitation, the Identified User declares that:
— the contact details, such as the invited Friend's mobile number or email address, are accurate and belong to that Friend;
— the Friend who owns the mobile number and/or email address has consented to its transmission to the Company by selection in the App and accepts the inclusion of their full name in the invitation sent to them. Otherwise, the Identified User is liable to Telekom Payments and third parties for any resulting damage.
If, following the referral, a Friend registers and opens an electronic-money account with Telekom Payments, the referral is considered successful (“Successful Referral”). For a referral to qualify as a Successful Referral, the Friend must:
a. meet the conditions for becoming a Telekom Payments customer for the first time under the current Terms of Use;
b. provide the required data and complete registration and authentication to create an electronic-money account with Telekom Payments in the App; and
c. accept these Terms of Use, which are binding on the customer in their entirety.
A Successful Referral does not give rise to any financial or other reward except during periods when a relevant promotional campaign is conducted under the conditions below and the specific terms of that campaign.
“Promotional Campaign”
As part of “Refer a Friend”, the Company may occasionally organise promotional campaigns of limited duration in which Identified Users receive a monetary or other reward for each Successful Referral (“Promotional Campaign(s)”). Telekom Payments specifies the particular terms of each campaign in writing when it is launched (for example, eligibility and method of participation, duration, type of reward and reward process) and publishes them, at its discretion, on the Website, in the App and/or by other suitable means. Those specific campaign terms supplement these Terms of Use, form a single and indivisible whole with them, and bind participating Identified Users without any further action being required.
II. “COINS” LOYALTY PROGRAMME
The “Coins” loyalty programme (the “Programme”) allows Identified Users to collect points that may be redeemed in accordance with these Terms or other terms established by the Company. Participation means that the participating Identified User has read, agreed to and fully and unconditionally accepted the following conditions, which exclusively govern their rights and obligations relating to the Programme.
“Eligibility”
Any natural person who is legally and permanently resident in Germany, has legal capacity, is at least 18 years old and holds a payment account with Telekom Payments may participate (a “Participant”).
“Participant Registration”
Registration in the Programme occurs when the Participant registers in the App and completes the Telekom Payments identification process.
“Removal of a Participant”
A Participant is removed from the Programme if they delete their payment account in the App.
The Company may remove or exclude a Participant for non-compliance with the Programme's terms or damage to the Company, in accordance with the “User Conduct” section of the App Terms.
If a Participant is removed for any reason, all accumulated, unredeemed Coins are deleted.
“Earning Coins”
From registration in the Programme, each Participant earns Coins for each approved transaction using a virtual Telekom Payments card or other activity (a “Transaction”), as described in the “Earn Coins” table and “Rules” section published under the Coins loyalty programme in the App and under Services / Coins Loyalty Programme on the Website. These specify eligible Transactions and the corresponding Coins. The Participant can see accumulated Coins in their Coins account.
No points are earned on: cash withdrawals of any kind; loading a payment card (debit, credit or prepaid); debits, credits or advance payments from Telekom Payments or other institutions (banks, payment institutions, electronic-money institutions, etc.); payments to a payment account with Telekom Payments or another institution; payments of all or part of the balance of a card issued by another institution; money transfers (incoming or outgoing); repayment of loan instalments; cryptocurrency purchases; gambling or betting transactions; transactions with public authorities (including municipalities, chambers, public- or private-law legal entities and payments of public debts); and any transaction disputed by the cardholder.
Telekom Payments may change or exclude categories of Transactions in accordance with “Amendment / Termination of the Programme”.
The number of Coins awarded for each Transaction is updated by Telekom Payments on the Company's Website and in the App under “Amendment / Termination of the Programme”.
Telekom Payments maintains only one Coins account per Participant to track earned and/or redeemed Coins.
Coins earned by a Participant may be redeemed at any time.
If Coins are incorrectly calculated to a Participant's benefit or detriment, Telekom Payments may make the necessary correction to the Coins account without prior notice.
Coins earned by a Participant may not be transferred or assigned to third parties.
Where a Transaction amount contains decimals, the number of Coins is rounded to the nearest whole number (for example, a EUR 3.49 Transaction earns 3 Coins, while a EUR 4.50 Transaction earns 5 Coins).
“Redeeming Coins”
A Participant's Coins may be redeemed in whole or in part within the App as electronic money credited to the Participant's payment account held with Telekom Payments through the App. Redemption uses the applicable Coins-to-money exchange rate published in the Coins section of the App and Services / Coins section of the Website, and requires at least fifty (50) Coins per redemption.
Telekom Payments may announce additional special offers for earning or redeeming Coins and change the minimum number required for partial or full redemption. Such offers may apply to all Participants, some Participants or particular Transactions. Announcements are made in accordance with “Amendment / Termination of the Programme”.
A Participant must hold a payment account with Telekom Payments at the time of redemption.
“Informing Participants of Available Coins”
Each Participant is informed through the App of the Coins accumulated and available for redemption.
Each Participant is informed of current redemption options by SMS, newsletter, email, the App or the Website.
Telekom Payments may periodically provide information about the Programme by SMS, newsletter or email using the contact details provided by the Participant during registration or subsequently.
“Amendment / Termination of the Programme”
Telekom Payments reserves the right to amend these Programme Terms at any time, including the “Earn Coins” table and “Rules” section.
Amendments are communicated through the App, Website and other appropriate means chosen by Telekom Payments and take immediate effect unless otherwise stated. Performing relevant Transactions or activities and/or redeeming Coins after an amendment constitutes acceptance of the amended Programme Terms.
Each amendment also specifies an effective date and, where applicable, a duration.
Telekom Payments may terminate the Programme at any time at its discretion, informing Participants one (1) month before the termination date via the Website, the App and/or other appropriate means. Participants may redeem their available Coins until the Programme ends.
Telekom Payments accepts no liability to Participants or third parties in connection with such amendment or termination, and participation implies waiver of any corresponding claim or right against Telekom Payments.
“Other Terms”
For the purposes of the Programme, Telekom Payments, as data controller, collects, retains and processes Participants' personal data, including identification and contact information necessary for processing, only to the extent disclosed by Participants upon registration or during participation. Telekom Payments takes all necessary measures to ensure the fair and lawful collection and processing of personal data and their secure storage under Regulation (EU) 2016/679 (GDPR), Law 4624/2019 and the applicable implementing legal framework, maintaining the secrecy and confidentiality of all information of which it becomes aware.
Telekom Payments may use Participants' personal data to send information about Programme opportunities and/or related matters.
Telekom Payments protects Programme members' personal data and does not disclose them to third parties (legal or natural persons) unless permitted under the Programme Terms or by law. Data may also be shared with Telekom Payments affiliates where necessary exclusively for support, implementation and operation of the Programme.
Telekom Payments processes Participants' personal data throughout their registration in the Programme and thereafter for as long as required by the applicable legal and regulatory framework.
III. “CHAT & PAY” MESSAGING SERVICE
The “Chat & Pay” messaging service (“Chat & Pay”) is a communication channel for Users and is intended for Identified Users.
Each Identified User is solely responsible for any content they post, publish, send, transmit or otherwise make available through Chat & Pay. They must comply with applicable laws and regulations, refrain from any unauthorised or abusive use of the App Services, and behave decently, courteously and discreetly while using the App.
Chat & Pay also allows electronic money to be transferred from one Identified User's payment account (E-Wallet) (debit) to another Identified User's payment account (E-Wallet) (credit).
“Sending Electronic Money”
Through Chat & Pay, each Identified User (the “Sender”) may specify an amount of electronic money to be transferred from their payment account (E-Wallet) to that of another Identified User (the “Recipient”). The Sender confirms the payment order using strong customer authentication (SCA), achieved through fingerprint (Touch ID), facial recognition (Face ID) or the relevant security settings on the Identified User's Device. Upon successful confirmation, the amount is credited to the Recipient's payment account (E-Wallet).
“Receiving Electronic Money”
The Sender may also request that the Recipient credit an amount to the Sender's payment account (E-Wallet). The Recipient may accept or reject the request. If rejected, the Sender is informed through Chat & Pay. If accepted and the execution of the payment order is confirmed through strong customer authentication as described above, the Recipient's payment account (E-Wallet) is debited and the Sender's payment account (E-Wallet) is credited.
IV. “SPLIT IT” EXPENSE-SHARING SERVICE
The “Split it” expense-sharing service (“Split it”) is designed to help Identified Users track their expenses and accounts and share costs with other Identified Users by allowing them to enter notes recording who owes what to whom and why. Split it allows Identified Users in a group to mark settlements and payments. The notes are the sole responsibility of the Identified User, and the Company accepts no responsibility for relationships between members of individual groups.
An Identified User may allocate one or more expenses to other Identified Users. Settlement of an allocation may involve transferring funds from one Identified User's payment account (E-Wallet) to another's.
An Identified User may create a group with other Identified Users to share expenses (such as payments) by adding them to the group through the App. Expenses may be divided among group members either:
— equally: the amount allocated to each group member is the total expense divided by the number of members; or
— by exact amount: the User who entered the expense specifies the exact amount allocated to each member.
All transactions arising from Split it are visible to the members of each group in the App's transaction list. Transactions may be settled within the App (for example, by transferring funds between Identified Users' E-Wallets) or outside it (for example, in cash); the creator of the expense must update the splits they entered in Split it accordingly.
The group creator may edit or delete the Split it group or a member at their discretion. Telekom Payments accepts no responsibility for transactions between Identified Users and does not participate in them. Telekom Payments neither guarantees nor verifies the accuracy or validity of expenses entered by Users.
V. “PIGGY” PERSONAL SAFE SERVICE
The personal safe “Piggy” (the “Piggy Safe”) is an additional payment account created and controlled by an Identified User for saving money. The Identified User who creates a Piggy Safe (the “Piggy Safe Holder”) can automatically view all Piggy Safe transactions, close or modify the Piggy Safe, and add or withdraw funds.
“Definitions”
— Piggy Safe Payment Account: an account held in the name of the payment-service user within the meaning of the App's Framework Agreement, used for payment transactions to load electronic money into, or redeem electronic money from, the Piggy Safe.
— Piggy Safe Holder: the Identified User of the App who has accepted these Terms generally and, in particular, the terms governing the Piggy Safe.
— Piggy Safe Goal: the desired amount to be accumulated and/or the time limit for saving the money. The maximum time limit is one (1) year.
“Creating a Piggy Safe”
Each Identified User may create one or more Piggy Safes in the App, up to a maximum of five (5).
As holder of each Piggy Safe, the Identified User may request its deletion at any time. The corresponding Piggy Safe payment account created for that purpose is automatically deleted.
The request is executed immediately. Any electronic-money balance remaining in the Piggy Safe is transferred free of charge to the Holder's main payment account (E-Wallet).
“Funding a Piggy Safe”
The Piggy Safe Holder may save electronic money in the Piggy Safe payment account as follows:
— by rounding up the amount of each transaction made with a Telekom Payments debit card to the next whole euro. The Holder may choose to multiply the saved amount by two or four;
— by recurring transfers of electronic money from the Holder's main payment account (E-Wallet) to the Piggy Safe payment account, weekly or monthly;
— by a one-off transfer of electronic money from the Holder's main payment account (E-Wallet) to the Piggy Safe payment account.
Strong customer authentication (SCA) by the Identified User is not required for the above transactions.
“Withdrawing from a Piggy Safe”
The Piggy Safe Holder may redeem electronic money from the Piggy Safe payment account exclusively into their main payment account (E-Wallet). SCA is not required for this transaction.
“Limits and Fees”
The maximum amount the Piggy Safe Holder may accumulate in the Piggy Safe in any month and/or year is directly related to the maximum permitted amount of transactions set by Telekom Payments for the particular transactions or activities of the Identified User. Where the Holder has more than one Piggy Safe, the total amounts accumulated in all Safes and the main payment account (E-Wallet) must not exceed the maximum permitted transaction amount set by Telekom Payments for the particular transactions or activities of the Identified User.
Redemption of the amount accumulated in each Piggy Safe is permitted without charge to the Identified User, unless Telekom Payments determines otherwise.
“Information”
Each Piggy Safe Holder can view the electronic money accumulated through the App and all Piggy Safe information (goal and completion, funding and withdrawal transactions, etc.), and may change their selections at any time (funding methods, goal, etc.).
Telekom Payments may periodically contact the Piggy Safe Holder by SMS, newsletter or email using contact details supplied during registration or subsequently.
“Interaction with the Split it Service”
An Identified User may allocate one or more expenses to several Identified Users and enter multiple expenses for a group of Users through Split it in the App. The expenses may be shared among group members and resulting payment requests settled using payment methods available through the App. In addition to those methods, expenses may be settled using the electronic money accumulated by the Holder in a Piggy Safe.
“Amendment of Terms”
Telekom Payments reserves the right to amend these terms for the personal Piggy Safe service at any time. Amendments are communicated to App Users, at Telekom Payments' discretion, through the Company's Website and the App and/or other appropriate means, and take immediate effect unless otherwise stated. Performing Piggy Safe activities after an amendment constitutes the Holder's acceptance of the amended terms.
Piggy Safe Holders should read the Terms of Use in the App or on the Website and revisit them regularly to learn of amendments and the latest applicable version.
Telekom Payments may terminate the service at any time at its discretion and inform Piggy Safe Holders one (1) month before the termination date through the Company's Website and/or the App and/or other suitable means. In that case, the amounts accumulated in each Piggy Safe are credited to the Identified User's main payment account (E-Wallet) after that period expires.
VI. “CARDS” SERVICE FOR THE ISSUANCE AND USE OF CARDS
Through the App, Identified Users may apply for a virtual Telekom Payments debit card by accepting the “Terms of the Agreement for the Issuance and Use of a Telekom Payments VISA Debit Card”.
VII. “COUPON” SERVICE
Telekom Payments may occasionally issue codes in physical or digital form as part of promotional campaigns (the “Coupons”), which correspond to and may be redeemed for Coins. Coupons are sent or allocated to Identified Users by any appropriate means chosen by Telekom Payments (for example, by email or post) and may be redeemed exclusively in the App under Earn with Magenta Pay > Coupons.
Coupons are valid for a specified period and contain a specified number of Coins, depending on the terms of the relevant promotion. A Coupon cannot be exchanged for cash, and its value is not refunded if it expires unused.
Each Coupon may be used only once. If partially used, the remaining Coins cannot be redeemed in a later transaction, are not stored and are not refundable. Coupons cannot be combined with other promotions.
Each Coupon is intended exclusively for the individual use of the User who is its lawful owner. Telekom Payments is neither responsible for nor obliged to replace or cancel a Coupon if it is stolen or lost, if the electronic messages through which it was sent are deleted, or if it is used by third parties.
Any abusive use of the service is expressly prohibited (for example, sharing a Coupon code with third parties or attempting to redeem random codes on a mass scale). If Telekom Payments becomes aware of such use, it reserves the right to apply the measures set out in Section 9, “User Conduct”.
6. SERVICES UNRELATED TO TELEKOM PAYMENTS SERVICES
Telekom Payments may also make available through the App services and products provided by third parties with which it cooperates. In such cases, the cooperating third party supplies Users through the App with information on the services/products offered and their terms of use, which Users must first accept in order to access the third-party services. In all cases, the services/products are provided by the third party, with whom Users enter into a contract and from whom performance is expected. Telekom Payments merely enables Users to access the relevant third-party service/product through the App.
Accordingly, the Identified User acknowledges and accepts that being a customer of the Company for Telekom Payments Services does not necessarily mean that the User automatically satisfies the terms and conditions set by a third party for its own products and services offered through the App, or that the User has any such entitlement against that third party. Telekom Payments expressly states, and the User acknowledges and accepts, that Telekom Payments bears no responsibility towards Users for the quality of services provided by third parties through the App. The third party with which the User contracts is solely responsible to the User for providing the services, and the User has no right to assert claims against Telekom Payments on that basis.
7. HELP AND SUPPORT
For clarification or enquiries about the App and Services provided through it, Users may contact Telekom Payments customer service by telephone on +49 228 534 14060, by email at info@magenta.pay, or by letter to “Telekom Payments – E-Money Services Single-Member S.A.”, 99 Kifissias Boulevard, 151 24 Maroussi, Attica.
Users may also obtain help and support relating to the operation of the App and its Services through the App as follows:
“Contact Form During App User Identification”
Users who have not completed identification can request support during registration by submitting an online contact form.
“Magenta Pay App Frequently Asked Questions (FAQ)”
Identified Users may read articles describing the operation of the App. Telekom Payments must keep these articles and their content appropriate and up to date.
“Yzy Bot”
“Yzy Bot” is an automated information and service channel for the App and its Services, intended for Identified Users. Each Identified User is solely responsible for content they post, publish, send, transmit or otherwise make available through Yzy Bot. They must comply with applicable laws and regulations and refrain from any unauthorised or abusive use of it.
“Telekom Payments Representative”
Depending on the circumstances, Identified Users may contact an available Telekom Payments representative by chat or by calling +49 228 534 14060 after submitting a support request through Yzy Bot. Alternatively, a Telekom Payments representative may contact them using the customer's contact number and preferred times to resolve the support request.
8. SECURITY
Throughout use of the App, the User must take all necessary steps to protect their mobile Device against theft or loss.
The User must handle their Device and any software needed to access and use the App appropriately and securely, and acknowledges that Telekom Payments is not responsible for the suitability or security of the Device or third-party software needed to access and use the App. Telekom Payments is not liable for damage to the hardware or software of the Device used for the App, or for data loss resulting from use of the App.
The User must ensure secure operation of their Device and the App, particularly by installing the latest updated versions of the application software and operating system supported by the Device, and by using only applications and programmes from trusted, reliable and certified software providers. Applications and programmes should be used only where the User is certain of their origin.
The User must not visit websites containing malware or websites of unknown or questionable origin on their Devices, because of the risk of infecting the Device and App with viruses or of altering, losing and/or disclosing personal data. Telekom Payments does not guarantee that, despite due care, the App will operate without interruption or be free of errors and viruses of every kind. The Company also accepts no liability for damage to the User's Device due to the absence of suitable antivirus protection. The User must therefore protect the Device before and during use of the App (using antivirus, virus-scanning or other protective software).
The User undertakes not to install the App on a Device whose operating system security has been bypassed (a jailbroken or rooted Device). Such Devices are vulnerable to malicious attacks and viruses that may compromise the security of the Device and App, among other things. Telekom Payments accepts no responsibility for actions performed through and/or on a jailbroken or rooted Device. The User bears sole responsibility for such actions.
The User acknowledges that they are obliged and solely responsible for safeguarding and protecting personal passwords and personalised security credentials, which are strictly personal and confidential. Telekom Payments recommends, and the User acknowledges and understands, that regularly changing passwords and personalised security credentials, including after their first use, is a necessary security measure that the User must implement. The User must not disclose, record or store such information in a way that makes it accessible to third parties.
Telekom Payments will never, for any reason or by any means (telephone, email or SMS), ask the User to disclose passwords or personalised security credentials, even if the User needs to be identified again. Any telephone call, email or SMS requesting such disclosure is suspicious and should be treated as such.
If a third party asks the User by telephone or otherwise to disclose passwords or personalised security credentials, the User must not comply and must immediately report the incident to Telekom Payments so that appropriate measures can be taken. The User must also take all necessary measures to protect the Device (for example, PIN) and access features (such as Face ID and Touch ID). On learning of theft, loss, misappropriation or unauthorised use of the Device, the User must immediately notify Telekom Payments using the dedicated telephone number in “Contact / Out-of-Court Dispute Resolution”. The User must exercise heightened care and diligence in meeting these obligations; otherwise, they act with gross negligence.
The User must remain informed of, and carefully follow, the information and security recommendations on the Telekom Payments Website.
9. USER CONDUCT
Opinions expressed through any media offered by the App belong to the Users expressing them. They do not represent the views of the Company, its management or employees. Telekom Payments accepts no liability or responsibility for Users' content and comments. App Users must comply with applicable laws and regulations and refrain from unlawful or abusive conduct in connection with use of the App, unfair competition practices and other unlawful practices.
The following, for example, are prohibited:
— using Magenta Pay for commercial purposes or purposes other than personal use;
— using the App in breach of laws and regulations governing Telekom Payments' activities, including, without limitation, laws concerning unfair competition generally and misleading advertising in particular, consumer protection, direct marketing generally and spam in particular, and personal-data protection;
— using the App to install or promote advertisements of any kind, unsolicited emails (spam), chain letters or any other form of unwanted promotion of content or correspondence, or to publish, send or transmit material containing viruses, malware or other code, files or programmes intended to interrupt, damage, destroy or interfere with the operation of software or computer hardware;
— using the App in a way that infringes copyrights, related rights, patents, product or service marks, trade names, trade secrets, other intellectual-property rights, third-party personality rights or privacy rights; or posting, transmitting or sending unlawful, threatening, defamatory, insulting, obscene, provocative, pornographic or hateful messages or other material that constitutes or encourages criminal conduct, gives rise to other claims or otherwise breaches the law. The App User is liable for all damage caused to the App by improper or unlawful use of the App and Services. If Telekom Payments becomes involved in litigation or is required to pay compensation because the User breached obligations under these Terms, the User must indemnify Telekom Payments accordingly;
— publishing content or materials that may be characterised as:
a) racist, sexist, homophobic, obscene, violent, cruel, vulgar or harmful to minors;
b) defamatory or libellous towards Users, groups or organisations, or expressions of hatred;
c) abusive, threatening or otherwise likely to harm App Users;
d) contrary to applicable local, national or international law, or inciting or encouraging a breach of such law;
e) offensive or otherwise inappropriate under the Company's policies; or
f) infringing the rights (including copyright, patents, trademarks, trade or business secrets) of any legal or natural person, or otherwise potentially unlawful.
In any case of unlawful use or use contrary to these Terms, Telekom Payments may terminate access to the App and notify the User accordingly. Users must indemnify Telekom Payments for all direct and consequential damage. Any failure by Telekom Payments to exercise rights arising under these Terms does not constitute a waiver of those rights.
10. REDIRECTION TO THIRD-PARTY WEBSITES
Where the App provides a link to third-party websites, the third parties (website providers) bear full civil and criminal responsibility for the security, legality and validity of the content of their websites and services, to the exclusion of any liability of Telekom Payments, including, without limitation, liability relating to intellectual and industrial property rights. Providing a link to a third-party website through the App in no way implies endorsement of the website or its content by Telekom Payments.
Users' navigation to other third-party websites is outside Telekom Payments' control. Telekom Payments therefore cannot be held responsible for their content, and App Users must contact the relevant third parties (website providers) directly regarding anything arising from visiting and/or using those websites. Although Users accept that Telekom Payments is neither obliged nor able to monitor the security and content of third-party websites and services to which it provides access, Telekom Payments may at any time remove, modify or discontinue third-party services or links if, in its discretion, the law or these Terms are threatened or breached. The User is notified each time before opening a third-party website or App.
11. INTELLECTUAL PROPERTY RIGHTS
Except for third-party rights, all App content, including images, graphics, photographs, drawings, texts, services and products, is the intellectual property of Telekom Payments and is protected by the relevant provisions of Greek law, European law and international conventions.
Any reproduction, distribution, transmission, processing, resale, creation of derivative works or misleading of the public as to the actual provider of App content is prohibited. Reproduction, republication, uploading, announcement, distribution, transmission or any other use of content by any means for commercial or other purposes is permitted only with the prior written consent of Telekom Payments or another copyright holder. Names, images, logos and distinguishing features associated with the App are exclusive trademarks of Telekom Payments or third parties, protected under applicable trademark laws. Their appearance in the App must not be construed as the transfer or grant of a licence or right to use them.
12. PROCESSING OF PERSONAL DATA
For the operation of the App and provision of Services through it, Telekom Payments, as data controller, collects, retains and processes Users' personal data in accordance with the applicable European and national legal and regulatory framework. Telekom Payments has informed the User clearly and comprehensibly about the processing of their data, the purposes of processing, the recipients of the data and the rights granted by the current legal framework. The User undertakes to inform Telekom Payments promptly of any change to their personal data. The collection, storage and processing of the User's personal data are governed by (a) the Telekom Payments Privacy Policy and (b) the Information on the Processing of Personal Data by the Magenta Pay App, available on the Company's Website.
13. OTHER TERMS – APPLICABLE LAW AND JURISDICTION
Any breach or indication of a breach of these Terms by the User results in immediate revocation of the User's right to download, install and use the App. If the User does not agree to the Terms, they must immediately remove the App from their Device and delete all copies. Users are advised to create backups before installation and regularly during use of the software.
Telekom Payments may suspend use of the App and its Services for reasons relating to security, suspected unauthorised or fraudulent use, or certification and verification of Users' identities. Telekom Payments notifies Users of the suspension and its reasons by any means it considers appropriate, where possible before the suspension or immediately afterwards, unless such notification conflicts with objectively justified security reasons or is prohibited by relevant EU or national law.
The suspension is lifted when the reasons for it no longer apply.
Any termination, cancellation or expiry of the Framework Agreement also automatically terminates provision of the App Services.
Telekom Payments makes every effort to ensure that the information and all App content are accurate, clear, complete, correct, appropriate, current and available, but gives no guarantee and therefore assumes no responsibility for these qualities. Telekom Payments shall in no event be liable for damage of any kind suffered by the User or a third party in connection with use of the App.
Telekom Payments is not liable for interruption of the App or any breach of these Terms due to force majeure, such as extreme weather, earthquakes, floods, fires, emergencies and similar events.
These Terms and all amendments are governed by and construed in accordance with Greek law, without prejudice to mandatory consumer-protection provisions of German or EU law where these provide otherwise. Disputes arising out of or in connection with the Terms shall be resolved by the courts at the User's place of residence or registered office, or at the place where the agreement between the User and Telekom Payments was concluded.
14. CONTACT / OUT-OF-COURT DISPUTE RESOLUTION
For claims, complaints or other disputes concerning the App and/or its Services, the User may contact Telekom Payments by completing the relevant claim/complaint form available on telekompayments.com. The completed and signed form should be sent by email to complaints@magenta.pay or by post to “Telekom Payments – E-Money Services Single-Member S.A.”, 99 Kifissias Boulevard, 151 24 Maroussi, Attica.
The Company provides Users with a dedicated telephone service available continuously, 24 hours a day (from Germany: 0228 534 14060; from abroad: +49 228 534 14060), for reporting loss, theft, misappropriation or unauthorised use of the Device; the service is recorded on magnetic media.
Any User may submit a complaint directly to Telekom Payments, which makes every effort to respond within fifteen (15) business days of receiving it, on paper or electronically.
For alternative or out-of-court settlement of disputes between the User and Telekom Payments concerning rights and obligations under these Terms and applicable law, the User may contact the independent authority “Consumer Ombudsman” (144 Alexandras Avenue, 114 71 Athens; tel. +30 210 6460862, +30 210 6460814, +30 210 6460612, +30 210 6460734, +30 210 6460458; email grammateia@synigoroskatanaloti.gr; website synigoroskatanaloti.gr/en), the Hellenic Financial Ombudsman for Banking and Investment Services (1 Massalias Street, 106 80 Athens; hobis.gr/en; tel. +30 210 3376700), or the German Federal Financial Supervisory Authority, BaFin (108 Graurheindorfer Strasse, 53117 Bonn; tel. +49 228 4108-0; fax +49 228 4108-62299; email schlichtungsstelle@bafin.de; website bafin.de).
